Property Registration

Registration of the property is one of the most tedious jobs in purchasing, selling or renting a property. You have to ascertain the market value of the property to calculate the stamp duty, transfer duty and registration fee payable on the instrument. The market value assistance counter in the Sub Registrar (CARD) office will provide these particulars if you furnish the details of the property in whose jurisdiction the property is situated.

As registration requires due diligence, Capital Properties ensures that the registration of residential or commercial property is carried out smoothly. The following steps are taken:

  1. Based on the market value of the property, stamp paper is purchased.
  2. The document is written and executed in the presence of two witnesses.
  3. The necessary enclosures are attached to the document.
  4. The document is presented to the Sub Registrar in whose jurisdiction the property is situated.
  5. The Sub Registrar scrutinises the document regarding its classification, payment of proper stamp duty, etc.
  6. Any deficit stamp duty is paid.
  7. The executant (seller) appears before the Sub Registrar and admits execution of the document. The two witnesses must be present before the Sub Registrar to authenticate the identity of the executant.
  8. The Sub Registrar endorses the admission of execution after following office procedures and adds the registration certificate on the document itself. The document is then returned to the claimant (purchaser) or their authorised agent.

In a CARD office the document is returned within one hour of presentation before the Sub Registrar. In a non-CARD office it is returned on the fourth day.
